General Talent Show Rules
“music.iLuv” TM, product of eBibelot Inc, has a musical talent show platform and can conduct "Talent Shows" defined by eBibelot Inc or other third-party partners. A "Talent Show" is defined on the Talent Show page of “music.iLuv” application. Unless specifically noted otherwise by eBibelot Inc via music.iLuv application, these terms and conditions shall serve as the general official rules for any Talent Show conducted through music.iLuv app, the specific details of each Talent Show are provided in music.iLuv Talent Show page for that specific Talent Show. The participants of the Talent Shows are supposed to create videos through music.iLuv application and share it on social media/networking websites including but not limited to twitter.com, instagram.com, facebook.com, youtube.com and plus.google.com (each, a “Social Media Site”). eBibelot Judges the Talent Show creations and announce the winner(s) per each, the details are provided below. eBibelot Inc, music.iLuv may terminate, extend, suspend or alter any Talent Show in its sole discretion.
We have included this overall talent show rules in the application for every Talent Show. Each Talent Show also has detailed description section. Additionally, we have included an overall official rules for the Talent Show in the application.
We, eBibelot Inc is the sponsor of the talent shows. Talent show rules are present per each Talent Show in the description areas as well as overall Talent Show rules in the app.
Apple is not involved in any way with the talent shows
The talent shows are musical shows for kids to encourage them to play music and share their creativity and be rewarded. It’s not for game, or Gambling or lottery or sport betting, casino games or horse racing. It’s only there to reward and motivate kids to play and perform music.
eBibelot and music.iLuv app is NOT offering any real money gambling or lottery.
eBibelot and music.iLuv app is NOT offering in-app purchase to purchase credit for use in conjunction with real money gaming of any kind, and may not enable people to purchase lottery or raffle tickets or initiate fund transfers in the app.
No purchase necessary to participate or win. A purchase will not improve one’s chance of winning. You must be a public member of the social media site that you share your talent show video. All video entries become the property of eBibelot Inc, and music.iLuv application and will not be acknowledged or returned. Winners will be chosen from the pool of Participants based on the specific talent show rules provided in the Talent Show page and will be announced within music.iLuv application and also on the respective music.iLuv Social Media Site.
eBibelot Inc.(music.iLuv) ’s clock will be the official time keeper for all Talent Shows. People can participate in more than one Talent Shows via sharing the creations (video content). Entries from one Talent Show will not be included in other Talent Shows automatically.
a. Unless otherwise specified in the Talent Show, winners will be selected by eBibelot Inc. (music.iLuv) through assigned Judges or people's vote if not specified in the rule description provided in the Talent Show page. b. Winners will be notified within 5 business days following the conclusion of the Talent Show via a tweet, Instagram post, or Facebook post (based on the platform on which the Winner entered the Talent Show) and the email specified in their profile setting. If a winner does not respond to such notification within 5 business days and/or does not meet the stated eligibility requirements, such winner will not receive any prize. Winners may be required to sign and return an Affidavit of Eligibility, Liability Release and, where legally permissible, a publicity release and/or provide other personal or tax information if needed. Winners will have 5 business days to provide all such information and to execute and return the Affidavit of Eligibility, Liability Release and publicity release (if required by eBibelot Inc. (music.iLuv). By entering, participants in the Talent Show release the Released Parties (defined below) from any claims, losses, injuries or damages of any kind resulting from participation in the Talent Show or the use or receipt of any prizes. Odds of winning a Talent Show will depend on the number of eligible entries received for the applicable Talent Show.
The number and value of prizes awarded in any Talent Show will vary and will be set forth in the Talent Show posting. Prizes are awarded “as is” with no warranty or guarantee, either express or implied. Prizes may not be substituted, transferred, or redeemed for cash except at eBibelot's sole discretion. eBibelot reserves the right, in its sole discretion, to substitute a prize (or portion thereof) with one of comparable or greater value. Prize includes only what is specified in the prize description. Winners of concert/event tickets must be available to attend such concert/event on the date specified or another winner will be selected by eBibelot Inc. Tickets are subject to certain terms and conditions as specified thereon. Seat locations will be determined by the concert/event’s venue. Winner and, if applicable, winner’s guest, must comply with all venue rules and regulations. eBibelot Inc. will not consider or fulfill any requests for additional or alternate prizes, including but not limited to requests for additional tickets, upgrades and/or alternate dates or seating. Winners are responsible for all applicable federal, state and local taxes, if any, as well as any other costs and expenses associated with prize acceptance and use not specified herein as being provided. All prize details are at eBibelot Inc. (music.iLuv) sole discretion.
Limitation on Liability
Entrants release, discharge, and agree to indemnify and hold harmless eBibelot Inc. (music.iLuv) and its respective directors, officers, employees, parents, subsidiaries, affiliates, agents, partners and representatives (the “Released Parties”) from and against any liability for any damages, injury or losses (including death) to any person, or property, of any kind resulting in whole or in part, directly or indirectly from acceptance, possession, misuse or use of any prize or participation in any Talent Show related activity or Participation in any Talent Show conducted by eBibelot Inc. (music.iLuv).
Illegible, inaccurate, damaged, misdirected, delayed, unintelligible or incomplete entries or responses will be disqualified.
Material which is (or promotes activities which are) sexually explicit, obscene, pornographic, violent, self-mutilating (e.g., relating to murder, the sales of weapons, cruelty, abuse, etc.), discriminatory (based on race, sex, religion, natural origin, physical disability, sexual orientation or age), illegal (e.g. underage drinking, substance abuse, computer hacking, etc.), offensive, threatening, profane, or harassing will be disqualified
The Released Parties are not responsible for any lost, late, misdirected, stolen or undelivered entries. The Released Parties are not responsible for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Talent Show, including, without limitation, errors or difficulties which may occur in connection with the administration of the Talent Show, the processing of entries, the announcement of the prizes and/or potential winner(s) or in any Talent Show-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Talent Show. Released Parties are not responsible for injury or damage to participants’ or to any other person’s computer related to or resulting from participating in this Talent Show or downloading materials from or use of the web site. Persons who tamper with or abuse any aspect of the Talent Show or website or who are in violation of these Official Rules, as solely determined by eBibelot Inc. (music.iLuv), will be disqualified and all associated entries will be void. In the event that technical or other circumstances compromise a Talent Show (including, without limitation, a computer virus, bugs, tampering, unauthorized intervention, technical failures, insufficient volume of eligible entries), eBibelot Inc. (music.iLuv) reserves the right, in its sole discretion, to cancel, modify or terminate the Talent Show, and/or to select winners for prizes from all eligible entries received prior to the cancellation based on the applicable winner selection methods described in Winner Selection of this document.Any attempt to deliberately damage or undermine the legitimate operation of a Talent Show may be in violation of criminal and civil laws and sponsor reserves the right to seek damages and other remedies (including attorney’s fees) from any such individual to the fullest extent of the law.
Claims/Choice of Law
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant in connection with any Talent Show, shall be governed by, and construed in accordance with, the laws of the State of California, without regard for conflicts of law doctrine, and all proceedings shall take place in the State of California. All participants who enter a Talent Show agree to submit to the exclusive jurisdiction of the courts of the State of California and agree to waive the right to a jury trial with respect to any claim or dispute with regard to any aspect of any Talent Show or these Official Rules. Under no circumstances will an entrant be permitted to obtain awards for, and entrants hereby waive all rights to claim punitive, incidental and consequential damages and any other damages, other than actual out-of-pocket expenses, including attorneys’ fees or other legal costs, and any and hereby waives all rights to have damages multiplied or otherwise increased.
For the names of the winner(s) of a Talent Show, please email within 30 days following the conclusion of the applicable Talent Show.
Talent Shows are in no way sponsored, endorsed or administered by, or associated with Apple, Twitter, Instagram, Facebook, YouTube, Google+, or any other Entity or Social Media Site utilized by the Talent Show.
If entering via Facebook, Instagram, Twitter and YouTube, or other social media sites you understand that by entering, you are providing your entry information to eBibelot Inc. (music.iLuv) and not Facebook or the specific social media.
Valid entries will be selected only from the following social media Facebook, Instagram, Twitter, and YouTube.
Specific Talent Show Rules
The following Talent Show rules will be provided in music.iLuv Talent Show page for each Talent Show announced:
Beginning/ending dates, including time and time zone. If not specific the timezone will be PDT timezone.
Specific Eligibility requirements in addition to the requirements described in General Talent Show Rules above.
Valid entries will be selected from the videos shared on the following social media only: Facebook, Instagram, twitter, and yourtube.
Valid entries must include description or title that specifies the Talent Show specific #hashtag (Talent Show name) and #musiciluv hashtag to be considered eligible for entry.
A clear description of the prize(s).
Date winner will be announced. If not specified it will be 5 days after the Talent Show End date.
Judging criteria and objective where applicable as part of the description. If not specific eBibelot Inc. (music.iLuv) will be the judge and the winner selection committee.
Method of selecting a winner. If not specified, the method of selecting winner will be based on eBibelot’s assessment of the quality of the musical video or number of likes received in the application or aforementioned social media accounts where the Talent Show creations (videos) are shared.
